VB Fitness Centre Ltd Membership Terms & Conditions

These Terms and Conditions form the agreement between VB Fitness Centre Ltd (“the Club”) and the individual purchasing membership (“the Member”).

1. Definitions

In these Terms and Conditions:

The Club refers to VB Fitness Centre Ltd, including its premises, staff, trainers, and services.

The Member refers to any individual holding an active membership with the Club.

Membership refers to the agreed subscription or payment arrangement granting access to the Club’s facilities and services.

Minimum Commitment Period refers to the minimum membership duration stated at the time of purchase.

Facilities refers to all gym equipment, training areas, and services provided by the Club.

Sessions refers to structured training sessions, group personal training sessions, or open gym sessions available through the booking system.

2. Health Attestation

Members confirm they are physically able to participate in exercise activities and do so at their own risk.

Members must disclose any relevant medical conditions or injuries that may affect their ability to exercise safely.

Members are advised to seek medical advice before beginning any exercise programme if they have health concerns.

3. Acceptance of Membership

The Club reserves the right to accept or refuse membership applications at its discretion.

Membership begins from the date of the first successful payment.

Memberships are personal and non-transferable and may not be shared with another individual.

4. Membership Fees

Members agree to pay the membership fee for the selected membership type regardless of attendance or facility usage.

Membership fees are non-refundable, unless otherwise stated.

Membership type, price, and any Minimum Commitment Period will be clearly stated at the time of purchase.

Members are responsible for ensuring their payment details remain valid and up to date.

The Club reserves the right to reasonably adjust membership pricing with at least 30 days’ notice.

Promotional or discounted memberships may revert to standard pricing after the promotional period.

5. Minimum Membership Commitment

Some memberships include a Minimum Commitment Period, which will be clearly stated at the time of purchase.

During this period, members remain responsible for all membership payments regardless of attendance.

Notice of cancellation may not be used to shorten the Minimum Commitment Period.

After the Minimum Commitment Period has ended, membership continues on a rolling monthly basis unless cancelled with 30 days’ written notice.

6. Missed or Failed Payments

Members remain responsible for all payments due during the Minimum Commitment Period.

Cancelling a card payment or failing to make payment does not terminate membership.

If payment fails, the Club may:

* Suspend access to the facilities
* Recover unpaid membership fees
* Charge reasonable administration costs
* Refer outstanding balances to a debt recovery service

Members agree not to initiate a payment dispute or chargeback without first contacting the Club to resolve the matter.

Where a valid chargeback is raised, the Club reserves the right to recover the outstanding balance and associated administrative costs.

7. Cancellation and Termination

Members may cancel membership after the Minimum Commitment Period by providing 30 days’ written notice.

If a member cancels during the Minimum Commitment Period, they remain responsible for the remaining membership payments due for that period unless cancellation is permitted under the circumstances below.

Members may cancel early with 30 days’ notice and a £20 administration fee if:

* They move more than 10 miles from the Club
* They suffer a long-term illness or injury
* They become pregnant and are advised not to exercise
* They experience redundancy or financial hardship

Members may also cancel if:

* The Club relocates more than four miles
* The Club closes for more than four consecutive weeks
* The Club significantly changes its opening hours

The Club may terminate membership where a member:

* Breaches these Terms and Conditions
* Harasses or abuses staff or other members
* Behaves in a disruptive or unsafe manner
* Causes damage to Club property
* Commits illegal acts on the premises

8. Membership Freezing

Membership may be frozen where a member cannot train due to injury, illness, pregnancy, or financial hardship.

Evidence may be required.

Freezes are normally limited to one freeze per 12-month period, up to a maximum of six months.

Payment breaks are not available for personal holidays.

9. Use of Facilities

Members must behave respectfully toward staff and other members.

Members must:

* Follow staff instructions and safety guidelines
* Use equipment responsibly
* Return equipment after use
* Maintain appropriate personal hygiene
* Clean equipment after use
* Bring a gym towel to sessions

Only clean indoor training footwear may be worn on the gym floor. Outdoor shoes are not permitted in training areas.

Members use the facilities at their own risk.

The Club is not liable for injury unless caused by proven negligence.

Members may be held responsible for damage to equipment or facilities caused through negligent or improper use.

10. Session Bookings

All sessions must be booked in advance through the Club booking system.

Sessions last 50 minutes and begin at the scheduled time shown in the booking system.

Members may book up to four sessions in advance.

Members arriving late may receive a shortened session or be refused entry depending on capacity and trainer discretion.

Members must only participate in the type of session they have booked.

Members attending group training must follow the structure of the session and trainer guidance.

Members attending open gym sessions may not join structured training sessions unless booked.

The Club may restrict or suspend booking privileges where members repeatedly:

* Fail to attend booked sessions
* Cancel sessions late
* Attempt to participate in unbooked sessions
* Misuse the booking system

By booking a session, members confirm they have read and agreed to these Terms and Conditions.

Trainers may stop or modify exercises if they believe there is a safety risk.

11. Photography and Filming

Photography or video may occasionally take place for marketing purposes.

Members may appear incidentally in background footage.

Members may not film or photograph other members or staff without consent.

Filming must not interfere with the safety or privacy of others.

Members who do not wish to appear in media should inform staff.

12. Opening Hours and Facilities

Opening hours and services are displayed on the website and booking system.

The Club may occasionally adjust opening hours or available services.

Equipment or areas of the facility may occasionally be unavailable due to maintenance or repair.

The Club may temporarily close due to maintenance, safety issues, or circumstances beyond its control.

13. Re-Joining Fee

The Club reserves the right to charge a joining or re-joining fee when a membership is restarted after cancellation or termination.

Re-joining may be refused where previous membership ended with unpaid balances or breaches of these Terms.

14. Parking

Free parking is available for members.

Members must avoid parking in front of neighbouring businesses during office hours.

15. Valuables

The Club cannot accept responsibility for loss, theft, or damage to personal belongings brought onto the premises.

16. Suspension of Access

The Club may suspend membership access where a member:

* Breaches these Terms
* Fails to make payment
* Behaves in an unsafe or disruptive manner

17. CCTV

CCTV monitoring operates within the premises for the safety and security of members, staff, and property.

Footage may be used for security and incident investigation purposes and will be processed in accordance with data protection legislation.

18. Personal Data

Member information will be collected and processed in accordance with applicable data protection laws and the Club’s privacy policy.

19. Member Communications

Important notices regarding membership, policies, or operational changes may be communicated via email, the booking system, or the Club’s website.

20. Staff Non-Solicitation

Members must not solicit or attempt to employ VB Fitness staff or trainers privately for training services outside the Club without written permission from VB Fitness Centre Ltd.

Members may not provide coaching, personal training, or paid instruction to other members within the Club unless authorised.

21. Children and Minors

Children are not permitted in the training area unless participating in a supervised session authorised by the Club.

Parents or guardians remain responsible for supervising children on the premises.

22. Emergency Procedures

Members must follow all emergency procedures and staff instructions during emergencies or evacuations.

23. Events Outside Our Control

The Club is not responsible for service interruptions caused by circumstances beyond its control, including government restrictions, building damage, power failures, or public health emergencies.

24. Changes to Terms

The Club may update these Terms and Conditions for legal or operational reasons.

Members will be given 21 days’ notice of significant changes where possible.

25. Agreement

By purchasing a membership or booking sessions, the Member confirms they have read, understood, and agreed to these Terms and Conditions.
